Terms and Conditions

• We, as a merchant, shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorisation for any transaction on account of the cardholder. having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

• As per the Affordable Housing Policy, 2013, all unsuccessful applicants shall be refunded the booking amount within 15 days of holding the draw of lots.

• Once the applications relating to allotment of apartments in the project are received by the company, the same shall be scrutinised. Scrutiny shall be completed under the overall monitoring of the concerned District Town Planner (DTP). The scrutiny by the joint team of the company and DTP Jhajjar shall be completed within three months from the last date of receipt of applications. Applications found ineligible shall be returned within one month of completion of scrutiny, indicating the grounds of ineligibility along with the booking amount. No interest shall be paid in such cases.

• Allotment of apartments in the project shall be made by way of draw of lots. The date of draw shall be fixed by the Senior Town Planner, Rohtak Circle. After fixation of the date, an advertisement shall be issued by the company informing applicants about the date, time, and venue of the draw of lots in the same newspaper in which the original advertisement was issued.

• Up to 5% of the total number of apartments as approved in the building plans may be allotted by the company to its employees, associates, friends, relatives, etc., in accordance with policy.

• The draw for allotment shall be held under the supervision of a committee consisting of the Deputy Commissioner or his representative (at least of the Haryana Civil Services cadre), the Senior Town Planner (Rohtak Circle), DTP Jhajjar; and a representative of the company.

• Only complete applications fulfilling the criteria laid down in the policy shall be considered for the draw of lots. Applications with minor deficiencies (e.g., missing entries, incorrect affidavit lines, or illegible document copies) may be included, but, if declared successful, applicants shall be given 15 days to remove shortcomings, failing which their claim shall stand forfeited. The list of successful allottees shall also be maintained on the website of the Department.

• A waiting list of up to 25% of total available apartments shall be prepared during the draw of lots. In case of surrender by any successful applicant, an amount in addition to Rs. 25,000/- (as prescribed by amendment in the Affordable Housing Policy 2013, vide Notification No. PF-27/15922 dated 05 July 2019) shall be deducted. Waitlisted candidates who wish to withdraw may do so without penalty, with The booking amount is refunded within 30 days. The waiting list shall be maintained for 2 years, after
which Booking Amounts shall be refunded without interest. All unsuccessful applicants shall be refunded the booking amount within 15 days of the draw of lots.

• If the successful allottee fails to deposit instalments within the prescribed time, a reminder shall be issued for payment within 15 days. If the default continues, the list of defaulters may be published in a regional Hindi newspaper, with a further 15-day window for payment, failing which the allotment may be cancelled. In the event of cancellation or surrender, the following amounts shall be forfeited in addition to Rs. 25,000/- along with applicable taxes/charges/fees:

• Further interest on delayed payment and applicable taxes thereon shall also be deducted. Thereafter, the balance amount shall be refunded to the successful allottee.

• Once an apartment is allotted, it cannot be transferred by the company to any other person. The apartment shall also be prohibited from transfer or sale for up to one year after possession. Breach of this condition will attract a penalty equivalent to 200% of the selling price, to be deposited in the fund administered by the town and country planning departments. Failure to deposit such a penalty shall result in the resumption of the apartment and its re-allotment in consultation with the department.
